Terms of Service

These Terms of Service ("Terms") govern access to and use of the Forkbit nutrition data API and dashboard (the "Service"), operated by Daniel de Almeida Cruz da Cunha, a Brazilian sole proprietor (Empresário Individual) registered under CNPJ 41.170.091/0001-90, doing business as Forkbit ("we", "us") at forkbit.io. By creating an account or using the Service, you agree to these Terms.

1. Accounts

You must provide accurate account information and keep it up to date. You are responsible for all activity that occurs under your account, including activity performed using your API keys. You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.

2. API keys and security

API keys authenticate requests to the Service and are shown in full only once, at creation. You are responsible for keeping your API keys confidential and for any use of the Service that occurs through them. Notify us immediately if you believe a key has been compromised. We may revoke a key at any time if we reasonably believe it has been compromised or is being used to violate these Terms.

3. Acceptable use

You agree not to:

• Circumvent or attempt to circumvent rate limits, credit metering, or plan quotas.
• Resell, redistribute, or republish the underlying nutrition dataset as a standalone product or data feed.
• Use the Service to build a product that is substantially a reproduction of the Service itself.
• Use the Service in a way that is unlawful, infringing, or that transmits malware or harmful code.
• Attempt to reverse-engineer or bypass authentication or security controls.

4. Plans, credits, and rate limits

Access to the Service is metered by credits, which are consumed per request according to each endpoint's published cost. Your plan determines your monthly credit allowance and request rate limits. We may throttle or reject requests that exceed your plan's limits. Plan details, including current pricing, are published on our /pricing page and are incorporated into these Terms by reference.

5. Billing

Paid plans are billed in advance on a monthly or annual basis through our payment processor, Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel. Subscriptions renew automatically at the end of each billing period unless cancelled beforehand; cancellation takes effect at the end of the current billing period. Plan changes (upgrades, downgrades, or interval switches) are prorated in accordance with Stripe's standard billing behavior. Fees are non-refundable except where required by law or as otherwise stated at the time of purchase.

6. Nutritional data accuracy

Nutrition data made available through the Service is sourced from public datasets, including the USDA FoodData Central database, and may be supplemented or normalized by automated processes, including large-language-model-assisted parsing of free-text food descriptions. This data is provided for informational purposes only and is not medical, dietary, or nutritional advice. We do not guarantee the accuracy, completeness, or fitness for a particular purpose of any nutrition data, and you should not rely on it for medical decisions, allergen avoidance, or any use where inaccurate data could cause harm. Consult a qualified professional for dietary or medical guidance.

7. No user-generated content

The Service does not host or publish user-generated content. Free-text input you submit for parsing (for example, to POST /v1/parse) is used solely to generate a response to that request and is not stored as content, displayed to other users, or published.

8. Intellectual property

We grant you a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms and your plan. We retain all rights, title, and interest in the Service, including its software, branding, and any proprietary normalization or enrichment applied to underlying datasets.

9. Caching, storage, and attribution

You may store, cache, and index responses returned by the Service, including values you derive or compute from them, for use in your own applications and internal systems. This permission applies on every plan, including the free plan, for as long as your account is active. There is no expiration requirement and no obligation to re-request data on a schedule.

This permission does not limit Section 3. Whether cached or retrieved live, you may not resell, redistribute, or republish the underlying nutrition dataset as a standalone product or data feed.

No attribution is required. You are not obliged to display the Forkbit name, logo, badge, or a link to us anywhere in your application, its documentation, its app store listing, or on your website.

If you cancel your subscription or close your account while in good standing, you may keep data you have already stored, though you may no longer make requests to the Service. If we terminate your access under Section 10 for breach of these Terms or for non-payment, you must delete all data obtained from the Service within 30 days of termination. Section 3 survives termination of your account.

10. Termination

You may stop using the Service and cancel your subscription at any time from the billing dashboard. We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, or if we reasonably believe your use of the Service poses a security or legal risk to us or others.

11. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or fully accurate.

12. Limitation of liability

To the maximum extent permitted by law, Forkbit will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service, including reliance on nutritional data returned by the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us in the twelve months preceding the claim.

13. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or through the dashboard. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute arising from these Terms will be submitted to the courts of the Comarca de Passo Fundo, Estado do Rio Grande do Sul, Brazil, to the exclusion of any other, however special or privileged.
